My partner and I are splitting up. We own a home together. Can she take out a home equity line of credit without my signature?
Not legally, no. But beware. I used to be a realtor and know that sometimes one spouse will lie and/or forge papers to sell a house or get a loan.

It doesn't pay off your debt, it moves it around to something that has a lower interest rate.
The way it helps is if you stop using the credit cards and pay the line off at the same speed you would have if it was still credit cards. Then instead of paying 30% in interest, you pay 10-15% and the rest goes to principal.

The signature loan results in a "lump sum" of money the line of credit is collateralized (usually a lien against a house) and and has a "draw" period where you can borrow money for usually a period of 10 years and have a term of 20 years to repay. It is most similar to a secured credit card and is good if you plan to make a lot of large purchases/home improvements during the draw period.

My nephew was out of the country at the time his wife applied for a HELOC. Both of their names are on the title. She pocketed the entire $10K and sent the $20k to pay for a condominium she bought in her country, and my nephew had no knowledge of the transaction until he came back home from his trip. Shouldn't the title company require the non-borrowing spouse sign a WARRANTY DEED for the husband to sign at closing to show his consent? Can any spouse do this without the knowledge of the other to draw funds from the home they both own?
Thanks!
i am not totally positive but I am pretty sure that since your husbands name is on the house, anything that has to do with that property he has to sign as well. if he quick claims the house over to you, then you can sign on your own, provided you earn enough money to pay it.good luck
Yet no one ever asks me for my ID? Should I call them out on it everytime? Ask for a manager? What is their liability for not asking?
Simply if your worried about it pull both out when paying for something. You have to keep in mind most of the time the cashier is very busy or has been and the last thing on her mind is checking the back of your card. I don't believe they have any liability if they don't ask. I havn't heard of such a thing. It's up to you if you want the cashier to check your id. Most places it's not their policey to do that or at least if it is it doesn't get done because like I said they have lots to do
