Legal question: credit card debt. Law firm is after me. Can they sue me; I'm on Social Sec. for disability.

I have a law firm after me for a huge credit card debt, which I incurred during a lengthy nursing home stay over 5 yrs. ago. I was very ill, and came close to dying at the time. I had received a letter from a law office, only after I had gotten out of the nursing home, but I didn't realize what it was. I had contacted them after another letter was sent, later on (after I had figured out what the purpose of the letter was), telling them that I am on Soc. Security for disability. Then it was passed on to another law firm, sometime in the past few months. Should I contact them at all, or leave it alone? I am 53, and own absolutely nothing-not even a vehicle. My question is-can they still come for me with a court case, and sue me? Please Help!!!


They can sue you. But they cannot take or attach your Social Security disability payments. Contact a Legal Aid office nearest to you. Maybe they can help get these attorneys off of your back.

is my mother in law responsible for credit card debt of deceased husband?

my father in law passed and has about 19,000 in unknown credit card debt.her name is on none of these cards and paying them would put her in a terrible financial situation.if it matters we live in georgia.thank you

Mother-in-law credit card debt.... what should i do??

My mother in law, whom we financially support, ran up $16,000 in credit card debt behind our backs. She lives in texas, is single, and owns a home and car....her only income is pretty much social security. She also was very recently diagnosed with cancer.

OK, so we're dealing with the cancer, but I'm trying to figure out the most prudent way to handle with the credit card debt. The grim truth is that she probably won't be around for many more years.....and even if she is, since we take care of her financially (we bought the house, pay her bills, etc) I'm not one bit concerned about what the solution does to her credit rating.

Are my best options Debt Settlement or just cancelling the cards and letting the debt ride? Should she continue making minimum payments?

Finally, what is the best way to prevent her from getting any more credit cards? She's pretty much addicted to them.

I'd be really gratefull for any advice or suggestions.... thanks!


You say you "pay the bills," but whose name are the credit accounts in? If solely in her name, you and your husband have no legal responsibility for them.

That said, its a tricky situation where relatives are concerned. Truth is, it might be better to let them go delinquent - that will dry up the well for obtaining additional credit.

NC law regarding credit card debt left by deceased family member.?

My Father has passed and his only CC had about $20000 of debt on it. Myself and his wife had use of card but never signed agreement as liable. Can CC collect from them or estate? His estate is a living will trust acct. that I inherit, but is not declared mine until I withdraw the money. Is it protected from CC collections?


If you were only an authorized user on the card, and not an account holder, then you are not liable for the debt personally.

However, his estate must pay all debts before any inheritance can pass on to the heirs. So indirectly, you will pay the $20k because the estate will be worth $20k less by the time it passes to you.

If his entire estate is worth less than $20k, then the debt must be paid as much as possible, the remaining balance should be canceled and you aren't liable for it, but you won't inherit anything.

When you die, what you own must stand good for what you owe, including both secured AND unsecured debts. Make sure you consult an attorney throughout the process to make sure everything is done within the law. If you improperly disperse funds from the estate to an heir, it could make the heir liable for the debt.

What's gonna happen now that my credit card debt went to a law firm/office?

They called several times and never left a message.

Are they gonna sue asap?


The next step is for them to sue you, unless you contact them and arrange to make payments, which I suggest, unless you want to pay for everything, plus court costs. It's always better to talk to creditors rather than ignore them.
