Recieved a summons for credit card debt, what can I do?

I have read alot of detail forums and comments regarding what I can do. I have recieved a summons (civil case) for a credit card debt. From what I have read, you can response to the summons that you are defending it. From there, I can send a letter to have them provide proof that the debt (or file Discovery) is mine to the collectors. If they can not provide proof, I can get the case dismissed. Is this true?
From collection agency that bought my debt from the credit card company. Better to file bankruptcy or try to have them provide validication to the debt with documents. If all fails, then fail bankruptcy? What is the best thing to do first?

Is it the actual credit card issuer or collection agency?

Please go immediately to budhibbs.com for advice on how to handle this, or register at creditboards. They are very helpful and will help guide you through the process.

Oh, and if you don't show up for court, you CANNOT be arrested...they will get a default judgment against you, but not appearing on a civil case is NOT a crime. They are counting on you not to show up...99% of the time, their rent-a-lawyers have no paperwork and nothing to back up their "case".

How should I repay my credit card debt?

This forum has been really helpful in the past.
I might not use the advice always but I always appreciate the feedback.
Here's the scoop- I currently have $55,000 in Credit card debt.
It is totally stressing me out and it is really dificult to keep up with the payments.
1-Shoud I us a debt consolidation ageny. I spoke with them and they claim they can greatly reduce the interest and thus the monthly payments- but you do need to pay them a fee. Also, the payments are still close to what I pay now but I can get the cards paid off in 5 years instead of 17 years.

2-Should I get a home equity Loan.

3- should I use my saving to pay this off- I have about $95,000 in the bank.

Thanks for the advise!!!

I cannot say much more to the previous answer. You need to pay the debts you owe, period. You have the money. If they find out you ACTUALLY have the money, they could come after you again with fraudulent intentions. And yes, your credit will go to "hell in a hand basket" using debt consol. Same as B-ruptcy, essentially.

I'll tell you from a USA standpoint. When you owe money you owe money and there is no way of getting out of it except to pay it, like get a second job or a third job if necessary to repay it. Otherwise it will continue to draw interest and acquire late fees and you'll be worse off. Here they garnish wages if you do not set up an appropriate repayment schedule and make payments. You should never have ignored their harrassing phone calls. In the USA if you are under age or if you still live with your parents they can put a lien against their assets and make them sell their car and even their house if they were that mean. Otherwise they just put liens on the car and house and when they are sold then the bank gets their money back however the longer this goes on the more you will owe and the longer it will take to get rid of the bank.

So I would suggest that you get two or three jobs and work this off. And try to set up a repayment schedule with them since garnishments are embarrassing to you and will hurt your career too and they end up on your credit report which will prevent you from buying anything else and may even hold you back from getting an apartment.

So contact that bank or collection agency and get their name and address and phone and write them and tell them what you can afford and the payments you plan to make starting when. If they think that's not enough they will let you know and/or just ignore you and take you to court.

Write that bank that holds the card that was stolen and ask what occurred. Did you file a police report? And did you write them as well as call them to tell them it was stolen?

When you say your father helped you close three credit cards what did you mean? Because the only way they can be closed is if you or your father paid them in full. If your father paid them in full then you need to find the checks he paid them with to close the account and get a copy and send that copy to the bank who is trying to collect the money from you. If they were paid in total then tell them that and show them the proof. Be sure to keep a copy of everything you send to them for your own file. Wait to see what they say.

Generally if you send anything as important as this thru the mails then (here) you need to send it by Certified Mail with the green Return Receipt Requested form (that RRR will be returned to you...make a copy of it and keep the original and copy in your file). That's your proof that they received what you sent them.

$2100 Delinquent Credit Card Debt...A law firm is calling me?

I've posted this in the credit section, but I was hoping to get a few more answers from you guys, so I am posting it in this forum as well. Sorry for the crossposting.

I got a call from the Joe Precido Law Firm today, and the guy there says unless I pay $2100 immediately, they are going to take legal action.

Can they really do that?

What is the worse possible thing that can happen if I don't pay them immediately? I offered to pay in installments, but according the words "they are not an financial / loan institution", they are not willing to do so.

What should I do? The guy says he will expect a call from me by 12:30 tomorrow, in an effort to allow me one last chance to clear this up.

Anyone else had experience with this before? What did you do?

As long as you are making payments they can't do anything to you. They have probably already reported you to the credit scoring. Thats about the worse thing they can do to you. They are just full of hot air. They are here to scare you. Don't let them. Same thing has happened to me.

Credit Card Payoff? - Personal Finance, Personal Budget and Budget ...

As a result, it appears that I always have a negative balance on my debt, and each month it gets bigger. For example, I have already paid of my credit card for October and November, yet those accruals still add to my total "debt." (By total debt, I mean when Mint give you the "at a glance" of your Total Cash and Total Debt). now, if you were to total up your payments to the card in the trends page, then it will total all your transactions, and for that, make sure all of them are categorized properly. its really hard to get this total to match your credit card balance though because its totalling only the mint history, and you may have a longer history with this card. response:"..rest assured, our engineering are continually fixing the product bugs and functions" my response: "Again, you dont understand...you need to forward my message to the head of your customer service division." Their response:"I'll make sure to forward this to our engineering team for consideration. My apologies."
