the collector's lawyer sent me a letter saying that he will take this matter to the court unless he hears something from me within 30 days..what will happen if he sues? and what can I do at this moment? i tried to negotiate the debt but they just took the matter to the lawyer. i even asked breakdown of the total debt and state of limitation but they did not give me answer about it. i live in california and my last payment was january 2004. and the credit company charged off july 2004. please give me advice and help.
get a loan and pay them off, then pay back what you can.

It depends on the credit card company or the collection agency. Some are very aggressive in collection and are going to court for smaller amounts. I've seen collection agencies go to small claims for less than $300.
Sometimes it depends on where you live. If the credit card company or collection agency have an office in your locale, they are more likely to sue. They show up in small claims with a whole days worth of lawsuits.

it is very possible for the collection agency to threaten with court. once it goes to a collection agency, they are affiliated with lawyers and you just need to tell them. i can pay $25.00 a week and you must stick to it. $1500 is not a lot in debt, but if in a collection agency, you have ruined your credit. your debt cannot go up. and they cannot add any more finance charges to it. it is illegal.
if you are prepared to make a payment to clear it all up........ask them to settle with you for a flat amount of $900 .......otherwise, tell them ........its impossible for you to make the payments they want. they cannot deny a payment from you, so $25 a month is all you can do. if you try to do this BEFORE it gets a court order, you may be in luck.
just don't avoid them and pay what you can and you will be fine

No. It only restarts if and when you begin paying again. Once you pay them a penny, it reactivates the account. If it is past statute of limitations in state you now live, not state they or the loan are in, or state loan was signed, the state you now reside in, hire an attorney to write them a letter. It's less than $100.00 or cheaper, and takes care if it.
